Cancellation policy and withdrawal rights for distance and off-premises contracts
The interested party is informed that a consumer has a right of withdrawal from this agreement within 14 days when concluding the brokerage contract outside the business premises of the broker or exclusively via distance selling in accordance with § 11 FAGG. The withdrawal period begins on the day the contract is concluded. The submission of the withdrawal declaration can be made using the attached withdrawal form, but is not subject to any form.
If the broker is to take action before the expiry of this fourteen-day withdrawal period (e.g. transmission of detailed information, arrangement of a viewing appointment), an express request by the interested party is required, whereby the interested party - if the contract is fully performed within this period - loses his right of withdrawal.
Due to a different business practice, the naming of the business opportunity alone is sufficient as full performance of the real estate agent's service, especially if no further activities of the broker are desired or made possible by the interested party. In this case the brokerage contract can no longer be revoked and forms the basis of a commission claim if a legal transaction is subsequently concluded regarding a business opportunity named by the real estate agent.
In the event of withdrawal pursuant to § 11 FAGG, the consumer undertakes not to make use of the information obtained.
