Dual activity/close relationship
We kindly point out that by virtue of existing business practice we act as a dual broker. Furthermore, we would like to politely draw your attention to existing economic and familial close relationships. An existing economic close relationship arises from a regular business connection.
Right of withdrawal and withdrawal rights for distance selling and contracts concluded outside the business premises
The prospective client is informed that for a consumer upon conclusion of the broker's contract outside the broker's premises or exclusively via distance selling per § 11 FAGG there is a right of withdrawal from this agreement within 14 days. The withdrawal period begins on the day of contract conclusion. The submission of the withdrawal declaration can be made using the attached withdrawal form, but is not bound to any form.
If the broker should act before the expiry of this fourteen-day withdrawal period prematurely (e.g., transmission of detailed information, arrangement of a viewing appointment), it requires an explicit request by the prospective client, which – with complete fulfillment of the contract within this period – causes the withdrawal right to be lost.
As complete service delivery by the real estate agent, due to a different business practice, the naming of the business opportunity suffices, especially if the prospective client does not wish or enable any further activities by the agent. In this case the broker contract can no longer be revoked and is the basis for a commission claim if it subsequently leads to the conclusion of a legal transaction regarding a business opportunity named by the real estate agent.
In the case of withdrawal under § 11 FAGG the consumer agrees not to use the information gained.
