Dual activity/close relationship

We politely point out that by virtue of existing business practice we act as a dual broker. Furthermore we would like to politely point out existing economic and familial close relationships. An existing economic close relationship arises from regular business connection.

Right of withdrawal and withdrawal rights for distance selling and off-premises contracts

The prospective client is informed that for a consumer when concluding the broker's contract outside the broker's premises or exclusively via distance selling in accordance with § 11 FAGG there is a right of withdrawal from this agreement within 14 days. The withdrawal period begins on the day of the contract conclusion. The submission of the withdrawal declaration can be made using the attached withdrawal form, but is not bound to any form.

If the broker should start acting before the end of this fourteen-day withdrawal period (e.g., transmission of detailed information, arranging a viewing appointment), it requires an explicit request by the prospective client, which thereby – with complete contract performance within this period – loses their right of withdrawal.

As a complete service provision by the real estate agent, due to a different business practice, the naming of the business opportunity suffices, especially if the client does not request or enable further activities by the agent. In this case the broker contract can no longer be withdrawn and is the basis for a commission claim when subsequently a legal transaction is concluded regarding a business opportunity named by the real estate agent.

In the case of withdrawal under § 11 FAGG the consumer commits not to make use of the information obtained.
