Dual activity/relationship

We would like to inform you that by virtue of existing business practice we operate as a dual broker. Furthermore, we would like to point out existing economic and familial relationships. An existing economic relationship arises from a regular business connection.

Right of withdrawal and withdrawal rights in distance selling and off-premises contracts

The prospective client is informed that for a consumer, upon entering into the broker contract outside the broker's premises or exclusively via distance selling in accordance with § 11 FAGG there is a right of withdrawal from this agreement within 14 days. The withdrawal period begins on the day of the contract conclusion. The submission of the withdrawal declaration may be made using the attached withdrawal form, but is not bound to any form.

If the broker should act before the expiry of this fourteen-day withdrawal period prematurely (e.g., transmission of detailed information, arrangement of a viewing appointment), an explicit request by the interested party is required, which – with full contract performance within this period – loses their right of withdrawal.

As full service provision by the real estate broker suffices due to a different business practice the naming of the business opportunity, especially if the interested party does not wish or enable further activities by the broker. In this case the broker contract can no longer be withdrawn and is the basis for a commission claim if later a legal transaction on a business opportunity named by the real estate agent is concluded.

In the event of withdrawal pursuant to § 11 FAGG, the consumer undertakes not to use the information obtained.
