For this purchase option the following regulations apply:
- The tenant can submit one application from the sixth to the end of the tenth year, from the eleventh to the end of the fifteenth year, and from the sixteenth to the end of the twentieth year.
- From the beginning of the 31st year after first occupancy, there is no entitlement to later transfer.
- The Bauvereinigung (building association) has a right of first refusal in the event of the later transfer of the dwelling into ownership (co-ownership, condominium), which must be entered in the land register and whose legal consequences are described in the purchase agreement.
- The pre-emption right may not be deleted without the consent of the Bauvereinigung within fifteen years after the conclusion of the purchase agreement.
- It expires either after payment of the difference amount or at the latest after fifteen years.
- In the case of a (further) transfer within fifteen years after the conclusion of the purchase agreement, the owner must pay the difference amount, which results from comparing the sale value disclosed to the buyer at the time of the conclusion of the purchase agreement with the agreed purchase price, to the Bauvereinigung. (§ 15g WGG)
