We would kindly point out that, by virtue of existing business practices, we act as a dual broker. Furthermore, we would kindly point out existing economic and familial close relationships. An existing economic close relationship results from a regular business connection.

Right of withdrawal and cancellation rights for distance selling and off-premises contracts

The interested party is informed that for a consumer at the conclusion of the broker contract outside the broker's premises or exclusively via distance selling pursuant to § 11 FAGG there is a right of withdrawal from this agreement within 14 days. The withdrawal period begins on the day the contract is concluded. The submission of the withdrawal declaration may be made using the enclosed withdrawal form, but is not bound to any particular form.

If the broker is to act before the expiry of this fourteen-day withdrawal period (e.g., transmission of detailed information, arranging a viewing appointment), it requires an explicit request by the interested party, who thereby – with complete performance of the contract within this period – loses their right of withdrawal.

As full service provision by the real estate agent, due to different business practice, the designation of the business opportunity suffices; in particular if the interested party does not wish or enable any further activities by the agent. In this case the broker contract can no longer be withdrawn and forms the basis of a commission claim if, subsequently, a transaction is concluded on a business opportunity named by the real estate agent.

In the event of withdrawal under § 11 FAGG, the consumer agrees not to use the information obtained.
