Right of withdrawal and cancellation rights for distance contracts and off-premises contracts
The interested party is informed that for a consumer, upon conclusion of the broker agreement outside the broker's business premises or exclusively via distance selling according to § 11 FAGG, there is a right of withdrawal from this agreement within 14 days. The withdrawal period begins on the day of contract conclusion. The submission of the withdrawal declaration can be done using the attached withdrawal form, but is not bound to any particular form.
If the broker is to act before the expiry of this fourteen-day withdrawal period (e.g., transmission of detailed information, scheduling a viewing appointment), an explicit request by the interested party is required, which – with complete contract fulfillment within this period – results in the loss of the withdrawal right. As the complete service provision by the real estate broker, due to a nonstandard business practice, the naming of the business opportunity suffices, particularly if the interested party does not wish or allow any further activities of the broker. In this case the broker's contract can no longer be revoked and forms the basis for a commission claim if, subsequently, a legal transaction is concluded regarding a business opportunity named by the real estate broker. In the case of withdrawal under § 11 FAGG the consumer undertakes not to use the information gained.
