Instructions on withdrawal and rights of withdrawal for distance contracts and contracts concluded outside business premises

The interested party is informed that, for a consumer, upon conclusion of the brokerage agreement outside the broker's business premises or exclusively by means of distance communication pursuant to § 11 FAGG, there is a right of withdrawal from this agreement within 14 days. The withdrawal period begins on the day the contract is concluded. The declaration of withdrawal may be submitted using the provided withdrawal form, but is not subject to any particular form.

If the broker is to begin acting before the expiry of this fourteen-day withdrawal period (e.g. transmission of detailed information, arranging a viewing appointment), this requires an express request from the interested party, who thereby – if the contract is fully performed within this period – loses their right of withdrawal.

As complete provision of the real estate agent's service, due to a differing business practice, the identification of the business opportunity is sufficient, in particular if no further activities by the broker are desired or enabled by the interested party. In this case, the brokerage agreement can no longer be revoked and forms the basis for a commission claim if a legal transaction is subsequently concluded concerning a business opportunity identified by the real estate agent.

In the event of withdrawal pursuant to § 11 FAGG, the consumer undertakes not to make use of the information obtained.
