The withdrawal period begins on the day of contract formation. The submission of the withdrawal notice can be made using the provided withdrawal form, but it is not bound to any particular form. If the broker should act before the expiry of this fourteen-day withdrawal period (e.g., transmission of detailed information, arranging a viewing appointment), it requires an explicit request by the interested party, which thereby – with full performance of the contract within this period – loses his withdrawal right. As full service provision by the real estate agent suffices due to a different business practice the naming of the business opportunity, particularly if the interested party does not desire or enable further activities by the broker. In this case the broker's contract can no longer be revoked and is the basis of a commission claim if subsequently a legal transaction is concluded about a business opportunity named by the real estate agent. In case of withdrawal after § 11 FAGG the consumer undertakes not to use the information obtained.
