Building-rights plot

This is a building-rights plot belonging to Stift Klosterneuburg, with a 100-year contract. In view of sharply rising land prices, single-family homes and residential complexes are increasingly being built on land belonging to others.

In Austria, building rights are understood as the right to erect and own a structure on land belonging to someone else. The landowner remains the owner of the property and grants the person entitled to build the building right for a specified period. This is entered in the land register and can be sold, inherited and encumbered.

The building-rights model can noticeably reduce acquisition costs and therefore also the required amount of equity. For this project, a building-rights contract for 100 years was concluded with Stift Klosterneuburg. The building interest currently amounts to only € 0,92/m² of usable floor space per month.

Good reasons for building rights:

  • No acquisition of the land and therefore lower acquisition costs. This leads to a reduction in the equity requirement and any financing costs.
  • Stift Klosterneuburg, as an institutional contractual partner, provides security and continuity.
  • You can use, sell, rent out and encumber the building-rights apartment like an owner.
  • Your rights are also secured in the event of inheritance.
  • Termination during the term is not possible.
  • For buyers of investment apartments, building rights offer an additional cost advantage. Since the land is not acquired when purchasing a building-rights apartment, a larger share of the acquisition costs can be deducted for tax purposes. The building interest can also generally be recognised as an expense when the apartment is rented out.

Purchase ancillary costs

  • Real estate transfer tax: 3,5 % of the purchase price plus contract preparation costs
  • Registration fee: 1,1 % of the purchase price as well as, proportionately according to useful values, 1,1 % of 18 times the annual building interest plus contract preparation costs
  • Costs of preparing the contract, including the establishment of condominium ownership and escrow handling (contract drafter: attorney-at-law Mag. Marlene Krüger): 1,5 % of the purchase price plus VAT and cash expenses
  • No commission for buyers
