Cancellation policy and rights of withdrawal in distance selling and off-premises contracts
The interested party is informed that for a consumer, when concluding the broker contract outside the broker's premises or exclusively via distance selling in accordance with § 11 FAGG, a right of withdrawal from this agreement exists within 14 days. The withdrawal period begins on the day of conclusion of the contract. The submission of the withdrawal declaration can be made using the attached withdrawal form, but is not bound to any particular form.
If the broker is to act before the expiry of this fourteen-day withdrawal period (e.g., transmission of detailed information, scheduling a viewing appointment), an explicit request by the interested party is required, which, with complete fulfillment of the contract within this period, results in loss of the right of withdrawal.
As complete service provision by the real estate agent, due to a different business practice, the naming of the business opportunity suffices, especially if the interested party does not wish or enable any further activities of the agent. In this case the broker's contract can no longer be withdrawn and forms the basis for a commission claim if a subsequent legal transaction is concluded over a business opportunity named by the broker.
