Right of withdrawal and withdrawal rights in distance selling and off-premises contracts

The prospective buyer is informed that for a consumer, when concluding the broker agreement outside the broker's premises or exclusively via distance selling in accordance with § 11 FAGG there is a right of withdrawal from this agreement within 14 days. The withdrawal period begins on the day of the contract conclusion. The submission of the withdrawal declaration can be made using the attached withdrawal form, but is not bound to any form.

If the broker should act before the expiry of this fourteen-day withdrawal period (e.g., transmission of detailed information, arrangement of a viewing appointment), it requires an explicit request by the prospective buyer, who thereby – if the contract is fully fulfilled within this period – loses his right of withdrawal.

As complete service provision by the real estate agent, due to a different business practice, simply naming the business opportunity suffices, especially if the prospective buyer does not desire or enable any further activities by the agent. In this case the broker contract cannot be withdrawn any more and is the basis for a commission claim if, subsequently, a legal transaction is concluded about a business opportunity named by the real estate agent.

In the case of withdrawal under § 11 FAGG the consumer undertakes not to make use of the information obtained.
