The property is a weekend house on leasehold land (superstructure) at a bathing pond in the locality of Zwerndorf in the municipality of Weiden an der March in the district of Gänserndorf, Lower Austria, near the border with Slovakia.

The weekend house was built around 1971 and consists of a solid basement and a ground floor in timber frame construction; later an extension at the lakeside (conservatory) was added, which was submitted for approval around 2019 and approved. Since neither the start of construction nor the completion was reported, the building permit from 2019 has expired. Also, according to the municipality the ridge height is too high (about 4.9 m). To approve the existing building, a new application would need to be filed and the ridge of the extension would have to be removed. For the existing building stock, there is thus no permit.

The exterior basement walls are according to the floor plan made of 30 cm thick concrete. On the ground floor there are 14 cm thick timber frame walls. The pitched roof is covered with Welleternit. The ground floor has a living usable area of about 70 m², the basement has a usable area of about 26 m².

The house has on the ground floor (excluding the conservatory) wooden windows with insulated glazing and exterior shutters. The house is heated on the ground floor with electric radiators and infrared panels.

The residential house is in a neglected and technically outdated condition. The concrete structure at the shore has partially sunk.

The property on which the weekend house was built is owned by the municipality of Weiden an der March. In 2023 a lease for parcels 16+17 was concluded. The total area of parcels 16 and 17 is 581,8m² according to the lease. As annual rent an amount of € 3.781,70 was agreed. The rent is hedged against inflation with a 3% cap. According to information from the municipality of Weiden an der March the rent for the year 2026 is € 4.152,42. The lease agreement runs until 31.12.2048.

The municipality of Weiden an der March would enter into a lease of identical content with the buyer. The new contract requires the approval of the municipal council.
