Residential development on a spacious area

With around 4,366 m² designated as building land-residential area, an area is available that permits different forms of housing, provided that these comply with the applicable building regulations. For developers and project developers, the possibility of structuring the plot as part of an overall plan and dividing it into several buildings or independent building plots is particularly interesting.

Both traditional detached houses with private gardens and semi-detached houses or a residential complex with several units are conceivable. Which option can actually be implemented depends on the geometry of the plot, the applicable development regulations and the required infrastructure provision.

The approximately 753 m² additionally designated as recreational area can be taken into account in the conceptual planning. Its specific use is governed by the applicable designation regulations.

Building regulations of the municipality of Oberwart

The Burgenland Building Act, the Burgenland Building Ordinance and the applicable local development regulations of the municipality of Oberwart are decisive for the structural use of the property.

The published Oberwart development guidelines generally provide for a maximum structural utilization of 40 % for plots in the building land-residential area, unless deviating special provisions apply to the relevant area.

In addition, the following requirements in particular must be taken into account:

  • Type of development: Depending on the applicable regulatory area and local requirements, different types of development may be considered.
  • Setbacks from boundaries: In open development, at least 3 m must generally be maintained from the lateral plot boundaries. Under the Burgenland Building Act, this type of development generally requires a plot width of at least 15 m.
  • Building height and number of storeys: These are governed by the local specifications applicable to the respective plot.
  • Development density: The permitted structural utilization must be assessed on the basis of the specifically applicable development guidelines or any partial development plan.
  • Infrastructure provision: The transport connection and the required supply and disposal lines must be taken into account in project planning.

The ultimately permissible development must be clarified with the competent building authority on the basis of the specific plot numbers and the provisions applicable to them.

Plot division and legal framework

Due to the size of the plot, division into several independent building plots is generally conceivable.

However, such a division is not equivalent to an existing building-law approval. Its actual feasibility depends in particular on compliance with the applicable development regulations, the size and layout of the newly created plots, and their secured infrastructure provision.

Implementation requires an appropriate subdivision plan prepared by a surveying engineer authorized for this purpose, as well as the necessary official and land-register steps. Any access and utility rights, as well as the effects of the different land-use designations, must be considered separately.

The number and size of possible building plots, as well as the buildings and residential units that can be realized on them, must be determined as part of specific project planning.

Land-register situation

A right of repurchase in favor of the municipality of Oberwart is registered in the land register. It was established in connection with the purchase agreement dated 15 November 2023 and an agreed construction obligation of 24 months. According to point 8 of the contractual agreement, the right of repurchase had to be exercised no later than six weeks after the expiry of the construction obligation.

The contractually stipulated exercise period ended on 27 December 2025. As the right of repurchase was not exercised within this period, it has expired in accordance with the contractual provision.

Any land-register deletion of the registered right that may still be required must be carried out separately.
