At the transport hub, the U-Bahn lines U4 and U6 meet. In addition, regional trains of the Franz-Josefs-Bahn as well as trains of the S-Bahn line S40 stop here. Furthermore, there is the possibility to transfer to tram line D and to several bus lines. According to customary business practice, LIM-BROKER GmbH (hereinafter “LB”) acts as a dual broker. It is further expressly stated that through a request about an object between the requesting prospective client (hereinafter “Client”) and LB, a broker contract is formed and, by agreement, in the event of a conclusion with the Client or a named third party by the Client LB will have a commission claim against the Client (pursuant to the Honorarverordnung for real estate brokers, BGBl. 262 and 297/1996) in the amount of 3% of the purchase price or 3 (for other objects, especially commercial objects) gross monthly rents plus 20% VAT arises. It is further stated that by agreement LB's commission claim in this amount against the Client also arises when, according to § 15 MaklerG (i) the business designated in the broker contract does not occur, not because of the client’s fault, but because the client, contrary to the previous negotiation, omits a necessary legal act; or (ii) with the mediated third party a different than purpose-equal transaction occurs, provided that the mediation falls within LB's area of activity; or (iii) the business designated in the exposé or contract is not concluded with the Client, but with another person, because the client has communicated to LB the opportunity to finalize with the third party known to LB; or the business does not occur with the mediated third party, because the mediated third party disclosed the business opportunity; or (iv) the business does not occur with the mediated third party because a statutory or contractual right of first refusal, repurchase or entry is exercised.
