Dual activity/Close relationship

We politely inform you that, by virtue of existing business practice, we act as dual agents. We would further like to point out existing economic and familial close relationships. An existing economic close relationship arises from a regular business connection.

Right of withdrawal information and withdrawal rights for remote sales and off-premises contracts

The prospective client is informed that for a consumer upon conclusion of the broker's contract outside the broker's premises or exclusively via distance selling pursuant to § 11 FAGG there is a right of withdrawal from this agreement within 14 days. The withdrawal period begins on the day of contract conclusion. The submission of the withdrawal declaration can be made using the attached withdrawal form, but is not bound to any form.

If the broker is to act before expiry of this fourteen-day withdrawal period (e.g., transmission of detailed information, scheduling a viewing appointment), it requires an explicit request by the client, who thereby – with full performance of the contract within this period – loses their right of withdrawal.

As complete service provision by the real estate agent, due to different business practice, the naming of the business opportunity suffices, especially if the client does not wish or allow further activities by the broker. In this case the broker's contract can no longer be revoked and is the basis for a commission claim if subsequently a legal transaction is concluded over a business opportunity named by the real estate agent.

In the case of withdrawal under § 11 FAGG the consumer undertakes not to use the information gained.
