Dual activity/close relationship

We politely inform you that by virtue of existing business practice we act as a dual broker. Furthermore we would like to politely point out existing economic and familial close relationships. An existing economic close relationship arises from regular business connection.

Right of withdrawal and withdrawal rights for distance selling and off-premises contracts

The interested party is informed that for a consumer at the conclusion of the broker's contract outside the broker's business premises or exclusively via distance selling in accordance with § 11 FAGG there is a right of withdrawal from this agreement within 14 days. The withdrawal period begins on the day of contract conclusion. The submission of the withdrawal declaration can be made using the attached withdrawal form, but is not bound to any form.

If the broker is to act before the end of this fourteen-day withdrawal period prematurely (e.g., transmission of detailed information, arrangement of a viewing appointment), an explicit request by the interested party is required, which – with full contract performance within this period – loses their right of withdrawal.

As complete service provision of the real estate agent is sufficient due to a different business practice to name the business opportunity, particularly if the interested party does not wish or enable any further activities of the agent. In this case the broker's contract can no longer be revoked and is the basis of a commission claim if it subsequently leads to the execution of a legal transaction over a business opportunity named by the real estate agent.

In the case of withdrawal pursuant to § 11 FAGG the consumer undertakes not to use the information gained.
