Dual activity/Close relationships

We politely point out that by virtue of existing business usage we operate as a dual broker. Furthermore we would like to politely point out existing economic and familial close relationships. An existing economic close relationship arises from a regular business connection.

Right of withdrawal and withdrawal rights for distance selling and off-premises contracts

The prospective buyer is informed that for a consumer, upon conclusion of the broker contract outside the broker’s business premises or exclusively via distance selling in accordance with § 11 FAGG, there is a right of withdrawal from this agreement within 14 days. The withdrawal period begins on the day the contract is concluded. The submission of the withdrawal declaration can be made using the attached withdrawal form, but is not bound to any form.

If the broker should act before the end of this fourteen-day withdrawal period (e.g., transmission of detailed information, arranging a viewing appointment), an explicit request by the interested party is required, which – with complete fulfillment of the contract within this period – results in the loss of their right of withdrawal.

As full service provision by the real estate broker, due to deviating business practices, the naming of the business opportunity is sufficient, especially if the interested party does not require or enable further activities of the broker. In this case the broker contract can no longer be withdrawn and forms the basis of a commission claim if, subsequently, a legal transaction is concluded over a business opportunity named by the broker.

In the event of withdrawal under § 11 FAGG the consumer agrees not to use the information obtained.
