Right of withdrawal and withdrawal rights for distance selling and off-premises contracts

The interested party is informed that for a consumer, upon conclusion of the broker contract outside the broker's business premises or exclusively via distance selling pursuant to § 11 FAGG, there is a right of withdrawal from this agreement within 14 days. The withdrawal period begins on the day of the contract conclusion. The submission of the withdrawal declaration may be made using the attached withdrawal form, but is not bound to any form.

If the broker should act before the expiry of this fourteen-day withdrawal period (e.g., transmission of detailed information, arrangement of a viewing appointment), it requires an explicit request by the interested party, who thereby – with full contract fulfillment within this period – loses his right of withdrawal.

As complete service by the real estate agent suffices due to a different business practice, the naming of the business opportunity suffices, especially if the interested party does not wish or allow further activities by the broker. In this case, the broker contract can no longer be revoked and forms the basis for a commission claim if, subsequently, a transaction is concluded regarding a business opportunity named by the real estate agent.

In the event of withdrawal under § 11 FAGG the consumer undertakes not to use the information gained.
