• Dual activity/close relationship

• Withdrawal instructions and rights of withdrawal for distance selling and off-premises contracts

  The interested party is informed that for a consumer when concluding the broker contract outside the broker's premises or exclusively via distance selling in accordance with § 11 FAGG, there is a right of withdrawal from this agreement within 14 days. The withdrawal period begins on the day of contract conclusion. The submission of the withdrawal declaration may be carried out using the attached withdrawal form, but is not bound to any particular form.

  If the broker is to act before the expiry of this fourteen-day withdrawal period, for example by transmitting detailed information or arranging a viewing, an explicit request by the interested party is required, which – with complete performance of the contract within this period – causes them to lose their right of withdrawal.

  As complete service provision by the real estate agent suffices due to a different business practice the naming of the business opportunity, particularly if the interested party does not wish or enable further activities of the broker. In this case the broker contract can no longer be withdrawn and is the basis for a commission claim if, subsequently, a legal transaction is concluded over a business opportunity named by the real estate agent.

  In the case of withdrawal pursuant to § 11 FAGG the consumer undertakes not to make use of the information obtained.
