Information on the right of withdrawal and withdrawal rights for distance and off-premises contracts
The interested party is informed that, for a consumer concluding the brokerage agreement outside the broker’s business premises or exclusively by means of distance communication pursuant to § 11 FAGG, there is a right to withdraw from this agreement within 14 days. The withdrawal period begins on the day the agreement is concluded. The withdrawal declaration may be submitted using the provided withdrawal form, but is not subject to any particular form.
If the broker is to begin work before the expiry of this fourteen-day withdrawal period (e.g. transmission of detailed information, arranging a viewing appointment), this requires an express request from the interested party, who thereby loses their right of withdrawal if the contract is fully performed within this period.
Due to differing established business practice, the naming of the business opportunity is sufficient for the real estate agent to have fully provided the service, particularly if the interested party neither requests nor enables any further activities by the broker. In this case, the brokerage agreement can no longer be revoked and forms the basis for a claim to commission if a legal transaction is subsequently concluded concerning a business opportunity named by the real estate agent.
In the event of withdrawal pursuant to § 11 FAGG, the consumer undertakes not to make use of the information obtained.
