Withdrawal instruction and rights of withdrawal in distance selling and off-premises contracts

The prospective buyer is informed that for a consumer, upon conclusion of the broker agreement outside the broker's business premises or exclusively via distance selling according to § 11 FAGG, there is a right of withdrawal from this agreement within 14 days. The withdrawal period begins on the day of contract conclusion. The exercise of the withdrawal declaration may be made by using the attached withdrawal form, but is not bound to any form. If the broker is to act before the expiration of this fourteen-day withdrawal period (e.g., transmission of detailed information, arranging a viewing appointment), it requires an explicit request by the interested party, which – with full performance of the contract within this period – loses their right of withdrawal. As full service provision of the real estate broker, due to a different business practice, the naming of the business opportunity suffices, especially if the interested party does not wish or authorize further activities of the broker. In this case, the broker agreement can no longer be withdrawn and is the basis for a commission claim if, subsequently, a legal transaction is concluded on a business opportunity named by the real estate broker. In the case of withdrawal under § 11 FAGG, the consumer commits not to use the obtained information.
