Withdrawal instructions and rights for distance contracts and off-premises contracts

The prospective buyer is informed that for a consumer at the conclusion of the broker contract outside the broker's premises or exclusively via distance selling according to § 11 FAGG, a right of withdrawal from this agreement exists within 14 days. The withdrawal period begins on the day of contract conclusion. The submission of the withdrawal declaration can be made using the attached withdrawal form, but is not bound to any form. If the broker is to act before the expiry of this fourteen-day withdrawal period, it requires an explicit request by the interested party, who thereby – with full contract performance within this period – loses their right of withdrawal. As full service delivery of the real estate broker suffices due to a different business practice, the naming of the business opportunity suffices, especially if the interested party does not request or enable any further activities by the broker. In this case the broker agreement can no longer be revoked and is the basis of a commission claim if subsequently a transaction is concluded regarding a business opportunity named by the real estate broker. In the case of withdrawal under § 11 FAGG the consumer agrees not to make use of the information gained.
