Right of withdrawal and revocation rights for distance selling and off-premises contracts
The applicant is informed that for a consumer, when concluding the broker contract outside the broker's premises or exclusively via distance selling in accordance with § 11 FAGG, a right of withdrawal from this agreement exists within 14 days. The withdrawal period begins on the date of contract conclusion. The submission of the withdrawal declaration can be made using the attached withdrawal form, but is not bound to any form.
If the broker is to act before the expiry of this fourteen-day withdrawal period, for example by transmitting detail information or arranging a viewing appointment, an explicit request by the prospective client is required, which – with full performance of the contract within this period – loses his right of withdrawal. 
As full service provision by the real estate broker, due to a different business practice, the naming of the business opportunity suffices, especially if the prospective client does not wish or permit further activities of the broker. In this case the broker contract can no longer be revoked and is the basis for a commission claim if it subsequently leads to the conclusion of a legal transaction regarding a business opportunity named by the real estate broker. 
In case of withdrawal under § 11 FAGG, the consumer agrees not to make use of the information obtained.
