Withdrawal instructions and rights of rescission for distance selling and contracts concluded outside of business premises

The interested party is informed that for a consumer when concluding the broker agreement outside the broker's business premises or exclusively via distance selling in accordance with § 11 FAGG there is a right of withdrawal from this agreement within 14 days. The withdrawal period begins on the day of contract conclusion. The submission of the withdrawal declaration can be carried out using the attached withdrawal form, but is not bound to any form.

If the broker should act before the expiration of this fourteen-day withdrawal period (e.g., transmission of detailed information, arranging a viewing), it requires an explicit request by the interested party, which – with full performance of the contract within this period – loses their right of withdrawal.

As complete service provision of the real estate agent, due to a different business practice, the naming of the business opportunity suffices, especially if the interested party does not desire or enable further activities of the broker. In this case the broker's contract cannot be rescinded and forms the basis of a commission claim when subsequently a transaction is concluded regarding a business opportunity named by the real estate agent.

In the event of withdrawal under § 11 FAGG the consumer agrees not to use the information obtained.
