Withdrawal instruction and rights of withdrawal for distance selling and off-premises contracts
The prospective buyer is informed that for a consumer, when concluding the broker contract outside the broker's business premises or exclusively via distance selling per § 11 FAGG, there is a right of withdrawal from this agreement within 14 days. The withdrawal period begins on the day of contract conclusion. The submission of the withdrawal declaration can be made using the attached withdrawal form, but is not bound to any form.
If the broker is to act before the expiry of this fourteen-day withdrawal period (e.g., transmission of detailed information, arrangement of a viewing appointment), an explicit request by the client is required, which thereby – with complete contract fulfillment within this period – loses their right to withdraw.
As full service provision of the real estate agent, due to a different business practice, the naming of the business opportunity suffices, especially if the client does not wish or allow further activities by the broker. In this case the broker contract can no longer be withdrawn and is the basis for a commission claim when a transaction involving a business opportunity named by the real estate agent subsequently takes place.
In the event of withdrawal under § 11 FAGG the consumer commits to not use the gained information.
