Information on the right of withdrawal and rights of rescission for distance contracts and contracts concluded outside business premises

The prospective client is informed that, for a consumer, upon conclusion of the brokerage agreement outside the agent’s business premises or exclusively by means of distance communication pursuant to § 11 FAGG, a right of withdrawal from this agreement exists within 14 days. The withdrawal period begins on the day the contract is concluded. The declaration of withdrawal may be submitted using the provided withdrawal form, but is not subject to any particular form.

If the agent is to commence activities prematurely before the expiry of this fourteen-day withdrawal period (e.g. transmission of detailed information, arranging a viewing appointment), this requires an express request by the prospective client, who thereby – if the contract is fully performed within this period – loses their right of withdrawal.

Due to a differing business practice, the naming of the business opportunity is sufficient as complete performance of the real estate agent’s service, especially if the prospective client neither requests nor enables any further activities by the agent. In this case, the brokerage agreement can no longer be withdrawn from and forms the basis for a commission claim if a legal transaction concerning a business opportunity named by the real estate agent is subsequently concluded.

In the event of withdrawal pursuant to § 11 FAGG, the consumer undertakes not to make use of the information obtained.
