Dual agency/close relationship

Information on the right of withdrawal and rights of cancellation for distance contracts and contracts concluded outside business premises

The interested party is informed that, when a consumer concludes the agency agreement outside the agent’s business premises or exclusively by means of distance communication pursuant to § 11 FAGG, there is a right to withdraw from this agreement within 14 days. The withdrawal period begins on the day the contract is concluded. The withdrawal declaration may be submitted using the provided withdrawal form, but is not subject to any specific form.

If the agent is to begin acting before the expiry of this fourteen-day withdrawal period (e.g. transmission of detailed information, arranging a viewing appointment), this requires an express request from the interested party, who thereby – if the contract is fully performed within this period – loses the right of withdrawal.

Due to a differing business practice, the real estate agent’s complete provision of services is deemed fulfilled by naming the business opportunity, in particular if the interested party does not request or enable any further activities by the agent. In this case, the agency agreement can no longer be revoked and forms the basis for a commission claim if a legal transaction concerning a business opportunity named by the real estate agent is subsequently concluded.

In the event of withdrawal pursuant to § 11 FAGG, the consumer undertakes not to make use of the information obtained.
