Right of withdrawal information and withdrawal rights in distance selling and off-premises contracts

The prospective buyer is informed that for a consumer when entering into the broker contract outside the broker's premises or exclusively via distance selling in accordance with § 11 FAGG there is a right of withdrawal from this agreement within 14 days. The withdrawal period begins on the day of the contract conclusion. The submission of the withdrawal declaration can be made using the attached withdrawal form, but is not bound to any form. If the broker is to act before the expiry of this fourteen-day withdrawal period (e.g., transmission of detail information, arrangement of a viewing appointment), it requires an explicit request by the prospective buyer, who thereby – with full performance of the contract within this period – loses their right of withdrawal. As full service delivery by the real estate agent suffices due to a different business practice, the designation of the business opportunity named by the broker suffices, especially if the prospective buyer does not desire or enable any further activities of the broker. In this case the broker contract can no longer be withdrawn and is the basis of a commission claim, if it subsequently leads to the conclusion of a legal transaction concerning a business opportunity named by the real estate agent. In the event of withdrawal pursuant to § 11 FAGG the consumer agrees not to use the information gained.
