Notice of withdrawal and cancellation rights for distance selling and off-premises contracts

The prospect is informed that for a consumer when concluding the broker contract outside the broker’s premises or exclusively via distance selling pursuant to § 11 FAGG there is a right of withdrawal from this agreement within 14 days. The withdrawal period begins on the day of contract conclusion. The submission of the withdrawal declaration can be made using the attached withdrawal form, but is not bound to any form.

If the broker is to act before the expiry of this fourteen-day withdrawal period prematurely (e.g., transmission of detailed information, scheduling of a viewing appointment), an explicit request by the interested party is required, which thereby – with complete contract performance within this period – loses their right of withdrawal.

As full service provision of the real estate broker suffices due to a different business practice the naming of the business opportunity, especially if the interested party does not require or enable any further activities of the broker. In this case the broker contract cannot be revoked and is the basis of a commission claim if subsequently a legal transaction is concluded over a business opportunity named by the real estate broker.

In the case of withdrawal under § 11 FAGG the consumer undertakes not to make use of the gained information.
