Dual activity/close relationship

We would like to politely point out that we act as a dual broker by virtue of our existing business practice. Furthermore, we would like to politely point out existing economic and familial close relationships. An existing economic close relationship arises from a regular business connection.

Right of withdrawal and withdrawal rights for distance selling and off-premises contracts

\n

The prospect is informed that for a consumer, upon conclusion of the broker contract outside the broker's premises or exclusively via distance selling in accordance with § 11 FAGG there is a right of withdrawal from this agreement within 14 days. The withdrawal period begins on the day of the contract conclusion. The submission of the withdrawal declaration can be made using the attached withdrawal form, but is not bound to any form. If the broker is to act before the expiry of this fourteen-day withdrawal period (e.g., transmission of detailed information, arrangement of a viewing appointment), an explicit request by the interested party is required, which thereby – with full performance of the contract within this period – loses their right of withdrawal. As a complete service delivery by the real estate agent, due to a different business practice, the naming of the business opportunity suffices, especially if the interested party does not desire or enable further activities by the agent. In this case the broker contract can no longer be withdrawn and is the basis for a commission claim if subsequently a legal transaction is concluded on a business opportunity named by the real estate agent. In the case of withdrawal under § 11 FAGG the consumer undertakes not to use the information obtained.
